Best Property Lawyer in Pitampura, Delhi
Family property, a builder or seller who won't hand over, a tenant or relative in illegal possession, or a title you need checked before buying. We handle property matters from our Pitampura office.
A sale through General Power of Attorney, agreement to sell and will does not transfer ownership of immovable property — only a registered sale deed does, as the Supreme Court held in Suraj Lamp (2011). Many Delhi property disputes start there. Daughters have the same coparcenary rights as sons in Hindu joint family property, following Vineeta Sharma (2020), and can seek partition on that basis.
What we handle
- Partition of family and ancestral property
- Suits for possession against illegal occupants
- Title verification and due diligence before you buy
- Disputes over GPA, agreement-to-sell and will-based purchases
- Injunctions against dispossession or third-party sale
- Mutation, conversion and documentation disputes
We act for clients in Pitampura and nearby — Shalimar Bagh, Ashok Vihar, Prashant Vihar, Rani Bagh, Keshav Puram, Netaji Subhash Place, Wazirpur and Model Town — and across Delhi.
Family property and partition
Disputes between siblings, cousins and extended family are the most common property matters we see. Usually the property was bought by a parent or grandparent, one branch of the family is in possession, and the others want their share. The questions are whether the property is self-acquired or ancestral, who the legal heirs are, whether there is a valid will, and whether any earlier family arrangement was made. We gather the documents, prepare a family tree, and advise whether partition by suit, a negotiated settlement, or a sale and division of proceeds best serves you.
Possession and illegal occupation
A tenant who stopped paying, a relative who was allowed to stay and now refuses to leave, or a stranger who took over a vacant plot — the remedy is a suit for possession, often with a claim for mesne profits. Where the owner was dispossessed without legal process, the law provides a faster route if action is taken promptly. We also seek injunctions to prevent further construction or third-party transfers while the case is pending.
Before you buy
Many disputes could have been avoided with a proper check at the start. Our title report covers the chain of ownership, encumbrances and bank charges, the building plan, municipal and revenue records, and litigation searches. For leasehold properties we check the conversion status and any conditions imposed by the lessor. We also review the agreement to sell before you pay the advance.
GPA properties and regularisation
A large number of Delhi properties changed hands through GPA, agreement to sell, affidavit and will. Since Suraj Lamp (2011), these documents do not make the buyer the owner. Where you hold such papers, we advise on getting a registered sale deed executed, on conversion where applicable, and on protecting your rights against the original owner or their heirs.
How we handle your matter
Documents read end to end
Property cases turn on the chain of title. We trace every document — sale deeds, wills, GPAs, allotment letters and mutation records — before we advise.
Protection first
Where there is a risk of sale, demolition or dispossession, we seek an injunction and record the status quo before anything else happens.
Settlement where it works
Many family property disputes are best resolved by a registered family settlement or a negotiated partition. We push for that where it serves you, and litigate where it doesn't.
Property Disputes: common questions
Does a GPA sale make me the owner of the property?
No. The Supreme Court held in Suraj Lamp & Industries v State of Haryana (2011) that GPA, agreement to sell and will transactions do not convey title. They may give rights under the agreement, but ownership passes only through a registered conveyance deed. Many Delhi properties bought this way need regularisation.
Do daughters have a share in ancestral property?
Yes. After the 2005 amendment to the Hindu Succession Act, daughters are coparceners by birth with the same rights as sons. The Supreme Court held in Vineeta Sharma v Rakesh Sharma (2020) that this applies whether or not the father was alive on the date of the amendment.
How do I file a partition suit?
A partition suit is filed in the civil court with jurisdiction over the property, with every co-owner made a party. The court first declares the shares, and then divides the property by metes and bounds or orders a sale if physical division is not possible.
Someone has occupied my property illegally. What can I do?
You can file a suit for possession based on title, and seek mesne profits for the period of occupation. If you were dispossessed without due process, a quicker summary suit under section 6 of the Specific Relief Act is available if you file promptly. A police complaint may also be appropriate in cases of criminal trespass.
What checks should I do before buying a property in Delhi?
Verify the complete chain of title for at least thirty years, the status of any mortgage, the approved building plan, mutation in municipal records, any pending litigation, and whether the land is leasehold or freehold. We prepare a written title report.
Can I stop a relative from selling family property?
If you have a share, you can file a suit for partition or declaration and seek an injunction restraining any sale until the case is decided. Registering a lis pendens and giving public notice can also warn potential buyers.
What is a family settlement?
An agreement among family members that divides property to avoid litigation. A settlement that only records a division already made may not need registration, but one that creates or transfers rights for the first time generally does. We draft settlements so that they are enforceable.
