In short

Anticipatory bail under section 482 BNSS is a direction that, if you are arrested, you must be released on bail. It can be sought from the Sessions Court or the Delhi High Court. The Supreme Court held in Sushila Aggarwal (2020) that it need not ordinarily be limited to a fixed period and can continue until the end of trial. It is barred for some offences by special laws — for example under the SC/ST (Prevention of Atrocities) Act, where a prima facie case is made out.

What anticipatory bail does

Anticipatory bail is an order made before arrest. It directs that if the police arrest you in the case, you must be released on bail on the conditions the court sets. It does not stop the investigation. You still join it when called, but you do so without the threat of custody. For many people facing a false or exaggerated FIR, it is the most important step in the whole case.

How the court decides

The court weighs the nature and seriousness of the accusation, your role as alleged in the FIR, your criminal record if any, the risk of you fleeing or tampering with evidence, and whether the accusation appears aimed at harassing you. We address each point in the application with documents: proof of residence and employment, the history of the dispute, and anything showing the civil or matrimonial core of the complaint.

Interim protection at the first hearing

Where the police are likely to act quickly, we ask for interim protection at the first hearing while the court calls for the police report. The order usually directs that no coercive steps be taken if you join the investigation. On the next date, the court decides whether to confirm it.

After bail is granted

Keep a copy of the order with you, join the investigation on every date you are called, and follow each condition exactly. If the charge-sheet is filed, the protection usually continues through the trial. If there is a breach, the other side can apply to cancel it, which is why we explain every condition to you before you leave the court.

Why JPL Legal

How we handle your matter

Speed when arrest is close

We can prepare an application quickly once we have the FIR or complaint, and seek an early listing where arrest is imminent.

Applications built on facts

We show the court why custody is unnecessary — your roots, your cooperation, the civil nature of the dispute, and weaknesses in the allegations.

Protection that lasts

We ask for protection until the end of trial, as Sushila Aggarwal allows, so that you do not have to apply again at each stage.

Questions

Anticipatory Bail, Delhi: common questions

When should I apply for anticipatory bail?

As soon as you have a reasonable belief that you may be arrested — when an FIR has been registered, a complaint has been made, or a notice has been served. You do not have to wait for an FIR, but you need specific facts showing the threat of arrest.

Which court should I approach first?

The Sessions Court and the High Court have concurrent power, but the usual practice is to approach the Sessions Court first. If it refuses, a fresh application can be made in the Delhi High Court.

What conditions can the court impose?

Under section 482(2) BNSS, the court can require you to join the investigation when called, not to threaten or influence witnesses, and not to leave India without permission, along with any other condition it considers necessary.

Is anticipatory bail available in a dowry or cruelty case?

Yes, and it is often granted in matrimonial disputes, particularly for relatives who live separately and have only general allegations against them. The court looks at the specific role attributed to each person.

What if the police send me a notice to appear?

For offences punishable with up to seven years, the police should generally issue a notice under section 35 BNSS instead of arresting. If you comply, arrest should be the exception. Where you still fear arrest, an anticipatory bail application can be filed alongside.

Can anticipatory bail be cancelled?

Yes, if you breach its conditions, interfere with the investigation or threaten witnesses. Following the conditions strictly and cooperating with the investigation protects the order.

The FIR is in another state. Can I get protection in Delhi?

If you live in Delhi, the Sessions Court or High Court here can grant limited interim protection — known as transit anticipatory bail — for a period that allows you to approach the court with jurisdiction over the FIR.
