In short

If your property in Delhi is at risk while you live abroad, you do not have to attend every hearing yourself. A correctly executed and attested power of attorney lets an advocate act for you, and courts now allow much to be done by video conference. What matters most is speed - possession and construction that go unchallenged for years are far harder to undo than ones challenged in the first weeks.

What we handle

  • Relatives, tenants or caretakers refusing to hand back possession
  • Sale or transfer attempted on a forged or misused power of attorney
  • Partition of ancestral or jointly owned property between family abroad and in India
  • Injunctions to stop construction, sale or third-party rights being created
  • Mutation, title and registration problems found before a sale
  • Builder delays, cancellation and possession disputes

From our office in Pitampura we act for clients across Delhi — North, North-West, West, Central, East and South Delhi — and for NRIs with matters in the city.

Why NRI property disputes in Delhi go wrong

Distance is the whole problem. Property left with a brother, a tenant or a caretaker is looked after until the day it is not, and the first sign of trouble is usually a phone call about construction, a new tenant, or a sale nobody told you about. By then the other side has possession, the papers and the local advantage, and you have a flight to book.

Three patterns repeat in the matters we are asked to take. A family member in possession begins treating the property as their own and refuses to account. A power of attorney given years ago for a narrow purpose is used to sell or mortgage. Or a property is held jointly after a parent’s death, one branch of the family lives in Delhi, and the others abroad are simply left out of any decision.

None of these are hopeless. All of them get worse the longer they run, because the other side’s possession hardens, witnesses move on and documents disappear.

Power of attorney, done properly

Most NRI property matters stand or fall on the power of attorney, and most defective ones we see failed on small things.

Sign before the Indian Embassy or Consulate where you live, or have the document notarised locally and apostilled where the Hague Convention applies. Once it reaches India it must be stamped, and where it authorises the sale or other dealing in immovable property it must be registered. Name the attorney precisely, state exactly what they may do, and do not give wider powers than the job needs. A power of attorney to defend a suit does not need to include a power to sell.

Keep a copy, note the date, and revoke in writing, formally, when the purpose ends. Where a power of attorney has already been misused, revocation plus an application to the court is usually the fastest way to stop further damage.

Do you have to attend court in Delhi?

Rarely for procedural hearings. An advocate holding your power of attorney appears and files on your behalf, and much of a civil case is directions, pleadings and documents. Your presence tends to matter at evidence, and even there video conferencing is now routine in the Delhi courts for witnesses who live abroad.

What we do need from you is prompt instructions and clean documents. Scanned copies to begin, originals or certified copies when the court needs them, and honest answers about what was agreed within the family, including the parts that do not help you. Property litigation punishes surprises.

What your papers must show

Before filing, we read the chain of title: the registered sale deed or allotment, the mutation entries, tax receipts, electricity and water records, any partition or family settlement, the will or succession certificate where the property came by inheritance, and every power of attorney ever given. We look for gaps, unregistered transfers and documents that were never stamped.

This work decides the case more often than anything argued later. It also decides which relief to ask for first - possession, partition, cancellation of a sale deed, an injunction, or a declaration that a transaction is void.

Deadlines, and why speed matters

Limitation is not the only clock. An injunction is far easier to obtain before a building goes up than after, and a court asked to undo years of unchallenged construction will ask why you waited. Sales to third parties create buyers who claim to have paid in good faith, which turns a simple case into a complicated one.

If you have just learned that something is wrong, treat it as urgent even if the loss feels distant. Send us the papers, tell us what you know and what you only suspect, and we will tell you the same day whether an immediate application is needed or whether the matter can take the ordinary course.

Working with us from abroad

Send the documents by email or WhatsApp. We read them, then speak to you at a time that works where you live. You get our view of the strengths, the weaknesses and the realistic range of outcomes, the forum your matter belongs in, and the fee for the stage we are proposing, before any work begins.

After that, you get an update after every hearing with the date, what happened and what comes next. If a settlement within the family is the better route, we will say so - in property matters between relatives it often is, and a settlement recorded properly in court is worth more than a decree nobody obeys.

Why JPL Legal

How we handle your matter

We act while you stay abroad

With a properly attested power of attorney we appear, file and follow up in Delhi. You are involved in decisions, not in travel. We tell you honestly the few stages where your own presence or evidence genuinely helps.

Papers checked before the fight starts

Most NRI property cases turn on documents gathered years ago by someone else. We read the chain of title, the mutation entries, the registered deeds and any power of attorney first, and tell you what your position really is.

Time-zone realistic communication

Updates by email or WhatsApp after each hearing, with dates and what happened, so you are not chasing news across time zones or relying on family for second-hand accounts.

One office, one team

Your matter stays with the advocates who read the file. We appear before the Delhi High Court, the district courts including Rohini Courts, and the tribunals, so the case does not change hands when the forum changes.

Questions

NRI property disputes: common questions

Do I have to come to Delhi for my property case?

Usually not for every hearing. An advocate holding your properly executed and attested power of attorney can appear, file and argue for you. You may still be needed at a few points, most often to give evidence, and courts in Delhi allow evidence by video conference in many matters. We tell you in advance which dates genuinely need you.

How do I make a power of attorney from abroad?

Sign it before the Indian Embassy or Consulate in the country where you live, or have it notarised locally and apostilled if that country is party to the Hague Convention. When it reaches India it must be stamped, and it must be registered where it authorises sale or other dealings in immovable property. A defect here can sink an otherwise good case, so send us the draft before you sign.

My relatives have occupied my flat and will not leave. What can I do?

If you hold title, the remedy is a suit for possession, usually with an injunction restraining them from selling, letting or creating any third-party right meanwhile. Act quickly. Long unchallenged possession invites arguments about your delay and, at the extreme, a claim of adverse possession, which generally runs on twelve years.

Someone sold my property using a general power of attorney. Is that sale valid?

A general power of attorney, agreement to sell and will do not by themselves transfer ownership - the Supreme Court settled this in Suraj Lamp and Industries v State of Haryana in 2011. A sale needs a registered conveyance from someone with the right to sell. If a power of attorney was forged, revoked or misused, that is a ground to sue to set the transaction aside, and often to seek an injunction at once.

Is mutation in the municipal records proof that I own the property?

No. Mutation records who pays tax and is recognised for revenue purposes. It does not create or prove ownership, which comes from registered title documents and the chain behind them. It still matters practically, and an incorrect entry should be corrected, but do not buy or sell on mutation alone.

How long do I have to bring a property case?

Limitation depends on the relief. Many suits run on three years from when the right to sue arises, while a suit for possession based on title generally runs on twelve years from when possession became adverse. Deadlines are decided by facts, so send us the dates with the papers and we will tell you what is still open.

Can I sell my Delhi property while living abroad, and what about the money?

Yes, through an attorney holding a valid registered power of attorney. Rules under FEMA govern what NRIs may hold and repatriate - agricultural land, plantations and farmhouses cannot be bought by NRIs, though they may be inherited - and a buyer must deduct tax at source at the rate applicable to an NRI seller, which is higher than for a resident. Take tax advice on the rate and on any lower-deduction certificate before you sign anything.
