In short

If the police do not file a charge-sheet within 60 days — or 90 days for offences punishable with death, life imprisonment or ten years or more — an accused in custody becomes entitled to default bail under section 187 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The right must be claimed before the charge-sheet is filed, so the dates need to be tracked from the first day of custody.

What we handle

  • Regular bail, default bail and anticipatory bail across Delhi
  • Bail and quashing petitions in the Delhi High Court
  • Trials, discharge applications and criminal appeals
  • Economic offences — cheating, criminal breach of trust, forgery
  • Cyber crime complaints and frozen bank accounts
  • Cases under special laws such as NDPS and PMLA

From our office in Pitampura we act for clients across Delhi — North, North-West, West, Central, East and South Delhi — and for NRIs with matters in the city.

Criminal defence across Delhi

A criminal case can begin in any police station in the city, and move between the Magistrate, the Sessions Court and the Delhi High Court. We follow it through each of them. From the first call we identify the stage of the case — complaint, FIR, investigation, charge-sheet or trial — and the step that protects you right now.

Bail at every stage

Liberty comes first. Before arrest, we seek anticipatory bail. After arrest, we seek regular bail, and we track the investigation period so that default bail is claimed the day it becomes available. Where the Sessions Court refuses, we take the application to the High Court. Every application is supported by documents showing your roots in Delhi, your cooperation with the investigation, and why custody is not needed.

Economic offences and cyber crime

Cheating, criminal breach of trust and forgery cases often grow out of business or property disputes. We look for the civil core of the dispute, which may support quashing or settlement, while defending the criminal case on its own terms. In cyber crime matters we act both for victims — getting complaints registered and funds traced — and for account holders whose accounts have been frozen without good reason.

Trials and appeals

If the case goes to trial, we challenge the charges first where the evidence does not support them. At trial we prepare each cross-examination from the police file and the documents, and make sure every contradiction is on the record. After a conviction, we file the appeal within time and apply for suspension of sentence so that you are not in custody while the appeal is heard.

Questions

Criminal Lawyer, Delhi: common questions

What is default bail?

If the investigation is not completed and a charge-sheet is not filed within 60 days — or 90 days for offences punishable with death, life imprisonment or imprisonment of ten years or more — an accused in custody is entitled to be released on bail under section 187 BNSS. The application must be made before the charge-sheet is filed.

Can I go directly to the Delhi High Court for bail?

The High Court and the Sessions Court have concurrent power to grant bail, but the High Court usually expects an accused to approach the Sessions Court first unless there are special reasons. If the Sessions Court refuses, the High Court is the next step.

Is bail harder in NDPS or money laundering cases?

Yes. For commercial quantities under section 37 of the NDPS Act, and under section 45 of the PMLA, the court must be satisfied that there are reasonable grounds to believe the accused is not guilty and is unlikely to offend again. These applications need careful preparation from the record.

Can the police arrest me without notice?

For offences punishable with imprisonment up to seven years, the police should generally issue a notice of appearance under section 35 BNSS instead of arresting, following the principles in Arnesh Kumar v State of Bihar (2014). If you comply with the notice, arrest should be the exception, with reasons recorded.

My bank account has been frozen in a cyber complaint. What can I do?

Find out which police unit ordered the freeze and why. Where the freeze is disproportionate or not linked to the disputed amount, an application to the Magistrate or a petition in the High Court can seek release of the account, often limiting the freeze to the disputed sum.

What is a zero FIR?

Under section 173 BNSS, the police must record information about a cognizable offence regardless of where the offence took place, and transfer it to the police station with jurisdiction. Information can also be given electronically, and must be signed within three days.

Can a Look Out Circular against me be challenged?

Yes. A Look Out Circular that restrains travel without adequate grounds can be challenged by a writ petition in the Delhi High Court, which can quash it or allow travel on conditions.
