In short

A challenge to an arbitral award under section 34 of the Arbitration and Conciliation Act must be filed within three months of receiving the award, extendable by only 30 days more. Before or during arbitration, the court can grant urgent interim protection under section 9. In Delhi, civil and commercial suits valued above ₹2 crore go to the High Court's original side, and the rest to the district and commercial courts.

Civil and commercial litigation in Delhi

Business disputes in Delhi can be heard in the district courts, the Commercial Courts, the Commercial Division of the High Court, or before an arbitral tribunal. The forum affects the timeline, the costs and the leverage you have. We start by reading the contract — especially any arbitration or jurisdiction clause — and the correspondence, and then choose the route most likely to get you paid or protected.

Arbitration

Many commercial contracts in Delhi carry an arbitration clause. We act at every stage: urgent interim relief under section 9, applications for appointment of an arbitrator under section 11, conducting the arbitration, challenging or defending the award under section 34, and enforcing it under section 36. The deadlines at the challenge stage are absolute, so an award should be reviewed as soon as it is received.

Recovery and summary suits

Where money is owed on a written contract, invoice or acknowledgment, a summary suit under Order XXXVII forces the defendant to seek leave before defending. It is often the quickest way to a decree. For larger commercial claims, a commercial suit with a strong interim application can secure the amount while the case is pending.

Injunctions and interim protection

Many disputes are effectively decided at the interim stage. We seek injunctions against breach of contract, misuse of confidential information, interference with property and dissipation of assets, supported by the documents the court needs to act at the first hearing.

Why JPL Legal

How we handle your matter

The right court, and the right route

Suit, summary suit, arbitration or insolvency — each has different speed and leverage. We tell you which one serves your commercial goal.

Commercial court discipline

Commercial cases run on strict timelines for pleadings and disclosure. We file complete pleadings on time, so your case is never closed on a technicality.

Enforcement planned early

A decree or award is only useful if it can be enforced. We look at the other side's assets from the start and seek security where there is a risk.

Questions

Civil & Arbitration Lawyer, Delhi: common questions

How long do I have to challenge an arbitral award?

Three months from the date you received the signed award, under section 34(3) of the Arbitration and Conciliation Act. The court can extend this by up to 30 days for sufficient cause, but not beyond that.

Can I get urgent relief before arbitration starts?

Yes. Under section 9, the court can grant interim measures — such as an injunction or an order to secure the amount in dispute — before, during or after the arbitration. If relief is granted before arbitration, proceedings must usually begin within 90 days.

What if the other side won't agree on an arbitrator?

You can apply for appointment of an arbitrator under section 11 of the Act. For domestic arbitrations with a seat in Delhi, the application is made to the Delhi High Court.

Which disputes go to the Commercial Courts?

Disputes arising from commercial transactions — trade, supply, services, distribution, franchise, construction and similar — with a specified value of ₹3 lakh or more. Higher-value commercial suits in Delhi go to the Commercial Division of the High Court.

How is an arbitral award enforced?

Once the period to challenge it has expired, or a challenge has failed, the award is enforced like a decree of court under section 36. Filing a challenge does not automatically stop enforcement; a stay must be sought separately.

How long does a money recovery suit take?

A summary suit under Order XXXVII of the Code of Civil Procedure, or a commercial suit, moves faster than an ordinary civil suit because of strict timelines. Many cases settle once the defendant's leave to defend is refused or a strong interim order is passed.
