In short

A Delhi family court can hear a Hindu divorce petition if the marriage was solemnised there, the respondent lives there, the couple last lived together there, or — where the wife is the petitioner — she is living there on the date of filing, under section 19 of the Hindu Marriage Act. Choosing the right court at the outset avoids transfer fights later.

Divorce across Delhi

Family cases in Delhi are heard by family courts in each district, and connected criminal matters in the Magistrate courts. We act in all of them. Most clients come to us at one of three points: they want to part by agreement, they have been served with a petition, or a criminal complaint has been filed. At each point the first step is different, and the first advice you get shapes the rest of the case.

Maintenance and alimony

Financial disputes are often the hardest part of a divorce. Interim maintenance can be claimed as soon as proceedings begin, and permanent alimony is decided at the end or agreed in a settlement. Since Rajnesh v Neha (2020), both sides must file affidavits of assets and income, and the court compares them. We prepare your affidavit carefully and test the other side’s disclosures against bank records, tax returns and property papers.

NRI and cross-border divorce

When one spouse lives abroad, questions of jurisdiction, service of summons and recognition of foreign decrees arise. A foreign divorce is not automatically valid in India; it must satisfy section 13 of the Code of Civil Procedure. We advise NRIs on whether to file in India, how to appear by video conferencing, and how to enforce or resist a foreign order.

Custody and children

Custody is decided on the welfare of the child. We present a practical plan for the child’s care, schooling and contact with the other parent, and seek interim custody or visitation where needed. Where a child has been taken out of Delhi or out of India, we move quickly for the appropriate orders.

Strategy across every case

Divorce, maintenance, domestic violence and criminal complaints often run in parallel. We plan them together so that a step in one does not damage another.

Questions

Divorce Lawyer, Delhi: common questions

Which court in Delhi should I file my divorce in?

Under section 19 of the Hindu Marriage Act, you can file where the marriage was solemnised, where the respondent lives, where you last lived together, or — if you are the wife — where you are living. We choose the court that is most practical for you.

How is maintenance calculated?

Courts look at the income, assets and liabilities of both spouses, the standard of living during the marriage, and the needs of the children. Following Rajnesh v Neha (2020), both parties must file detailed affidavits disclosing their assets and income.

Is a foreign divorce valid in India?

A foreign divorce decree is recognised in India only if it meets the tests in section 13 of the Code of Civil Procedure, as explained in Y. Narasimha Rao (1991) — broadly, the foreign court must have had jurisdiction, and the grounds must be ones recognised by the law under which the couple married. Otherwise, a fresh petition in India may be needed.

Can a divorce case be moved to Delhi?

A case pending in another state can be transferred to Delhi by the Supreme Court on a transfer petition, most often granted to wives who face real difficulty travelling. Transfers within Delhi are decided by the District Judge or the High Court.

Can the Supreme Court grant divorce for irretrievable breakdown?

In Shilpa Sailesh v Varun Sreenivasan (2023), the Supreme Court held that it can dissolve a marriage that has irretrievably broken down, using its power under Article 142. Family courts do not have this power, so a divorce petition in a family court must rest on a statutory ground.

How is permanent alimony decided?

There is no fixed formula. Courts consider both parties' income and assets, the length of the marriage, the conduct of the parties and the needs of any children. It can be paid as a lump sum or in instalments, and in a settlement the parties agree it themselves.
