DRAT & NCLAT Cases

What are DRAT & NCLAT?

The Debts Recovery Appellate Tribunal (DRAT) and National Company Law Appellate Tribunal (NCLAT) serve as crucial appellate bodies in the Indian judicial system, addressing disputes related to debt recovery and corporate law.

DRAT: Handles appeals against orders passed by the Debts Recovery Tribunal (DRT) concerning financial disputes and loan defaults.

NCLAT: Primarily deals with appeals against orders from the National Company Law Tribunal (NCLT), Competition Commission of India (CCI), and Insolvency and Bankruptcy Board of India (IBBI).

Debts Recovery Appellate Tribunal (DRAT)

Cheque Bounce Cases

A cheque bounce occurs when a bank rejects a cheque due to insufficient funds, a signature mismatch, or other banking reasons. In India, cheque bounce cases are governed by Section 138 of the Negotiable Instruments Act, 1881.

Legal Implications of Cheque Bounce
๐Ÿ”น Criminal Offense: A dishonored cheque is considered a criminal offense under Section 138 of the Negotiable Instruments Act.
๐Ÿ”น Penalty & Imprisonment: The issuer can face a fine up to twice the cheque amount or imprisonment for up to two years, or both.
๐Ÿ”น Legal Notice: The payee must send a legal notice within 30 days of receiving the cheque return memo from the bank.
๐Ÿ”น Filing a Case: If the drawer fails to make payment within 15 days of receiving the notice, the payee can file a complaint in court within 30 days.
๐Ÿ”น Civil Liability: Apart from criminal action, the payee can file a civil suit to recover the cheque amount with interest and damages.

High Court Writ Petition

A writ petition is a legal remedy available to individuals and organizations to seek justice from the High Court when their fundamental or legal rights are violated. The High Court has the power to issue writs under Article 226 of the Indian Constitution to enforce rights and ensure justice.

Types of Writs Issued by the High Court

The High Court can issue five types of writs:

•  Habeas Corpus โ€“ To protect an individual from unlawful detention.
•  Mandamus โ€“ To direct a public authority to perform its legal duty.
•  Prohibition โ€“ To prevent a lower court or tribunal from exceeding its jurisdiction.
•  Certiorari โ€“ To quash an illegal order passed by a lower authority.
•  Quo Warranto โ€“ To challenge the legality of a person holding a public office.

A writ petition can be filed in the High Court in cases involving:
